Overview
Forensic medicine
Orthopaedic forensic medicine requires a competence that combines deep clinical and surgical knowledge with the principal institutions of civil, criminal and insurance law. Prof. Colao has worked as Court Expert Consultant (CTU) appointed by the Tribunal of Florence since 1992 and by the Court of Appeal of Florence since 1998 — a role that demands absolute impartiality toward the parties in dispute and methodological rigour in damage assessment. Over more than thirty years of expert activity, Prof. Colao has examined hundreds of case files across the main areas of orthopaedic-legal practice: medical professional liability (assessing clinical conduct against protocols and guidelines), road and private accident analysis, occupational diseases and service injuries for civil and military personnel, capacity-to-act evaluation, accident and health insurance policy analysis, civil disability assessment — including cases of aggravation — and evaluation of fitness for imprisonment. The forensic assessment involves a thorough physical examination, critical review of clinical and imaging documentation, and the drafting of a technical report compliant with the evidentiary standards required by the code of civil procedure.
Methodology
Expert practice and court proceedings
Court expert work (CTU) involves drafting a technical report filed with the court clerk's office, responding to specific questions formulated by the judge, and engaging in cross-examination with party expert consultants (CTP). Biological damage assessments follow the disability table criteria used in Italian case law and updated medico-legal schedules. Medical professional liability analysis draws on critical study of clinical records, operating protocols and reference scientific literature. Prof. Colao also acts as party expert consultant (CTP) in support of law firms and as consultant for insurance companies in the settlement of complex claims, and provides party consultancy in judicial autopsies ordered in cases of alleged medical liability.
Areas of expertise
Consultancy by subject matter
Insurance compensation
Prof. Colao provides medico-legal assistance in disputes concerning private insurance policy compensation, examining clinical and contractual documentation to determine the extent of indemnifiable damage according to the barème criteria set out in the policy.
Accident insurance policies
Analysis of accident insurance policies requires verifying the compatibility between the reported traumatic event and the contractual clauses, together with quantifying permanent sequelae according to the specific disability tables adopted by the insurer.
Health insurance policies
For health insurance coverage, Prof. Colao assesses the causal link between the reported condition and the policy terms, providing technical opinions in support of the insured party or the insurer in determining the indemnity due.
Biological damage compensation
Quantifying biological damage follows a rigorous methodological path: physical examination, analysis of medical records, and application of statutory tables or industry barème to establish the percentage of permanent and temporary disability.
Fitness for imprisonment
Assessing fitness for imprisonment requires a thorough clinical examination of the subject's health conditions, with particular attention to chronic conditions and functional limitations relevant to the judicial authority's decision.
Occupational diseases
Recognition of occupational diseases requires demonstrating the causal link between the work activity performed and the condition that arose, through analysis of occupational history, clinical documentation and relevant scientific literature.
Workplace accidents
In workplace accident cases, Prof. Colao provides technical consultancy to determine the degree of temporary incapacity and permanent sequelae, in support of social security bodies, workers and their legal counsel.
Civil disability
Assessment of civil disability involves evaluating the reduction in general working capacity according to ministerial tables, with a technical report drafted in support of medical commissions or appeal proceedings.
Civil disability with aggravation
In cases of aggravation of previously recognised conditions, re-assessment requires a detailed comparison between the current clinical picture and that of the previous examination, to document the actual functional deterioration and the resulting revision of the disability percentage.
